Nutrition Made Easy With Mindful Chef - Event Prize Draw Terms And Conditions

1. The Prize Draw is open to all Eligible Participants who comply with these Terms and Conditions.

2. For the purposes of these Terms and Conditions: 

a) “Data Protection Legislation” means all laws and regulations in the United Kingdom relating to data protection including the Data Protection Act 2018 and the laws and regulations of the European Union, the European Economic Area and their member states relating to data protection.

b) "Draw Date" means Monday 28 August 2023;

c) “Eligible Participant” means any individual who: i) is 18 years old or older; and  ii) is a Planholder; and  iii) has registered for the event prior to 13:00 on Wednesday 23rd August 2023 using the registration link (https://attendee.gotowebinar.com/register/8371028856362335325) by entering their full name and email address; and  iv) as well as registering for the event between the prize draw start date of Wednesday 16 August 2023 and the closing date of 13.00 on Wednesday 23 August 2023, entrants must be registered for a Mindful Chef account and link that with their Vitality Member account via Member Zone by the time of the prize draw closing date of 13.00 on Wednesday 23 August 2023. 

d) “Event” means the online Webinar named “Nutrition Made Easy with Mindful Chef” which will occur on 23 August 2023 between 13:00 and 14:00 BST, and will be available to view by Eligible Participants, Planholders and other persons who have registered via the Vitality website. 

e) “First Prize” means six (6) months of Mindful Chef recipe boxes with a retail value of £750, equivalent to two (2) meals for two (2) people per week for 26 weeks.

f) “Mindful Chef” means Mindful Chef Limited, a company registered in England and Wales with company number 09270945 and whose registered office address is Unit D Discovery House, Juniper Drive, London, United Kingdom, SW18 1UY. 

g) “Planholder” means a member of Vitality who has a current insurance plan, who has a Vitality membership number and is eligible to receive discounts with Vitality’s rewards partners.

h) “Prize(s)” means collectively the First Prize, Second Prize, Third Prize, Fourth Prize, Fifth Prize, and Sixth Prize.

i) “Prize Draw” means the random selection of six (6) winners out of the Eligible Participants for the Prizes on the Draw Date in accordance with clause 4.

j) “Prize Draw Period” means 00.01 14 August 2023 to 13.00: 23 August 2023 (inclusive).

k) “Second Prize”, “Third Prize”, “Fourth Prize”, “Fifth Prize” and “Sixth Prize” each mean one (1) Mindful Chef voucher worth £50 which can be used on any product on the Mindful Chef website (https://www.mindfulchef.com/) and in conjunction with any other offers / discounts.

l) “Vitality” means Vitality Corporate Services Limited, a company registered in England and Wales with company number 05933141 and whose registered office address is 3 More London Riverside, London, SE1 2AQ trading as VitalityHealth and VitalityLife.

3. All Eligible Participants will be automatically entered into the Prize Draw upon registering for the Event and linking their Vitality account. The Prize Draw is free to enter, and no purchase is necessary. Eligible Participants are deemed to have accepted, and to have agreed to be bound by, these Terms and Conditions upon registration for the Event. 

4. On the Draw Date, Vitality will randomly draw the names of six (6) Eligible Participants via a computer generator, who will be deemed the “Winner(s)” of the Prize Draw. A maximum of one (1) Prize will be awarded to each Winner.  

5. First Prize will be awarded to the Eligible Customer whose name is first drawn from the computer generator. The remainder of the Prizes will be awarded to those persons whose names are drawn second to sixth (inclusive) by the computer generator.   

6. Vitality will contact the Winners within 30 working days from the Draw Date. The Winners of the Prize(s) will receive their Prize via email within thirty (30) working days from the Draw Date (subject to any delays that are beyond Vitality’s control). The Winners will be contacted by email to confirm their awarding of the Prize(s). The Winners may start using their Prize upon receipt. 

7. All Prizes also subject to Mindful Chef’s terms and conditions and in accepting their Prize all Winners agree to be bound by these terms and conditions. 

8. Vitality will not be liable for any lost Prizes in the event that the Eligible Participant has changed their contact details and failed to notify Vitality of this change. 

9. The Prize(s) will remain valid for a period of 12 months from their issuing to the Winner(s), following which they will expire and not remain valid for use. The issuing date will be the date Vitality sends the Prize(s) to the Winner(s) via the email they provided upon registration for the Event.  

10. Eligible Participants acknowledge and consent to their name and email address (“Personal Data”) being made available to Vitality for administrative purposes relating to the Event and the Prize Draw. All Personal Data of the Eligible Participant(s) will be held and used for the purposes of the Prize Draw by Vitality in accordance with: a) Vitality’s Privacy Notice (which can be found on https://www.vitality.co.uk/privacy/ or if not, upon request from Vitality); and  b) the Data Protection Legislation. 

11. Vitality reserves the right to refuse entry or refuse to award a Prize to any Eligible Participant in breach of these Terms and Conditions.

12. Any decisions made by Vitality over the eligibility of Planholders to become Eligible Participants (making them eligible for the Prize Draw) will not be open to dispute and no correspondence will be entered into. 

13. Vitality must make available information that indicates that the Prizes were awarded to the Winners. To comply with this obligation Vitality will, upon request submitted in writing to the Marketing Department of Vitality Corporate Services Limited, 3 More London Riverside, SE1 2AQ, send the surname and county of residence of the Prize Winners to  the individual requesting such information.

14. Vitality accepts no responsibility for any Event registrations (whether from Planholders or other individuals) that are lost, or unsuccessfully completed, or any failure for an Eligible Participant being entered into the Prize Draw, due to a human error, technical fault, technical malfunction, computer hardware or software failure, satellite, network or server failure of any kind.  

15. To the fullest extent permitted by law, Vitality, its employees, officers and agents will not in any circumstance be responsible or liable: a) to compensate the Winner(s) or to award the Prizes; and  b) for any loss, damage, personal injury or death occurring as a result of the taking up of the Prize(s) except where it is caused by its own negligence or the negligence of its employees, officers or agent.

16. Vitality reserves the right to void, cancel, suspend, withdraw or amend any Prize where it becomes necessary to do so including in the event of fraudulent behaviour by any Eligible Participant.   

17. Vitality reserves the right to substitute any Prize with another prize of similar value in the event the Prize is unavailable due to circumstances beyond Vitality’s reasonable control. 

18. Subject to clause 17, the Prize is non-exchangeable, non-transferable and no cash alternative is offered.  

19. Vitality reserves the right to amend these Terms and Conditions on the provision of written notice or via Vitality’s website. 

20. The Prize Draw and these Terms and Conditions are governed by English law and Eligible Participants agree to submit to the exclusive jurisdiction of English and Welsh courts and tribunals with regard to any dispute or claim arising under these Terms and Conditions.
