Surprise and Delight Giveaway (the “Giveaway”) – Terms and Conditions

1. This Giveaway is open to all Eligible Participants who comply with these terms and conditions, as set out below. 

2. For the purposes of this Giveaway, the following terms shall have the meanings set out below:

a. “Gifting Period” means the period from Saturday 21 July 2023 – Sunday 31 December 2023. 

b. “Gift” means a bundle of Vitality branded merchandise worth approximately £20. For the avoidance of doubt, only one Gift per Eligible Participant is permitted 

c. “Eligible Participant” means any individual aged 18 years or over and resident in the United Kingdom, who complies with these terms and conditions. All members of staff of the Promoter and their families and any third parties or agencies connected with or involved in the administration of this Giveaway will be excluded from receiving any Gift. 

d. “Promoter” means Vitality Corporate Services Limited (company number 05933141) of 3 More London Riverside, London SE1 2AQ trading as VitalityHealth and VitalityLife. 

3. Under the terms of this Giveaway, an Eligible Participant may be eligible to receive a Gift in accordance with clause 4 where they post a picture on Instagram and “tag” @vitality_uk. For the avoidance of doubt, the picture must not be profane, offensive or otherwise inappropriate (as determined by the Promoter at its sole discretion) 

4. Approximately every two weeks during the Gifting Period (beginning on Saturday 21 July 2023), four Eligible Participants will be randomly selected from those Eligible Participants that have met the requirements under clause 3, and will be awarded with a Gift.  

5. For the avoidance of doubt, the Promoter reserves the right to refuse to gift to anyone in breach of these terms and conditions.  

6. The Gift is not transferable, non-exchangeable and cannot be redeemed for cash. 

7. The Promoter accepts no responsibility for Gifts lost, stolen or unsuccessfully completed due to a technical fault, technical malfunction, computer hardware or software failure, satellite, network or server failure of any kind. 

8. The Promoter reserves the right to void, cancel, suspend, or amend the gift where it becomes necessary to do so including in the event of fraudulent behaviour. 

9. Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the chosen participants or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the Gift except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. The statutory rights of Eligible Participants are not affected. 

10. These Terms and Conditions will be governed by English law and the parties submit to the jurisdiction of the English courts. 

11. The Promoter reserves the right to amend these Terms and Conditions in its sole discretion on the provision of written notice or via its website. 

12. Your name, email address and postal address will be requested during the process of providing the Gift. This data will be stored in accordance with the Vitality Privacy Notice.
