Vitality Magazine Specialized prize draw terms and conditions

This Prize Draw is open to all Eligible Participants who comply with these Terms and Conditions:

1. For the purposes of these terms and conditions:

a. “Active” means that the relevant Vitality Plan has no unpaid premiums, has not lapsed and has not been cancelled by the Member or by Vitality;

b. “Draw Date” means 1 June 2024.  

c. “Eligible Participant” means a person that is a Vitality Member and aged 18 years and over; 

d. “Member” means a member with an Active Vitality Plan;

e. “Prize” means one (1) Specialized gift voucher - worth five hundred pounds (£500);

f. “Prize Draw” means the random selection of one winner of the Prize on the Draw Date in accordance with clause 4;

g. “Prize Draw Period” means 00.01 3 May 2024 to 23.59 31st May 2024 (inclusive);

h. “Vitality” means Vitality Corporate Services Limited (registered number 05933141) of 3 More London Riverside, London SE1 2AQ;

i. “Vitality Plan” means a “VitalityHealth” private medical insurance plan, including Vitality at Work and Healthcare Trusts and/or a “VitalityLife” life insurance plan administered and arranged by Vitality.

2. In order to be eligible for the Prize Draw, an Eligible Participant must have completed Vitality’s 2024 ‘Member story’ magazine feedback form (the “Form”), available through an online Microsoft form, accessible through link within the Vitality magazine circulated via email and in the Vitality Member app on 3 May 2024. After completing the Form, Eligible Participants will be automatically entered into this Prize Draw;

3. Only one (1) entry into the Prize Draw per Eligible Participant is permitted.

4. On the Draw Date, Vitality will use a computer generator to randomly draw the name of one (1) Eligible Participant, who will be deemed the “Winner” of the Prize Draw.

5. The Winner will be subject to the terms and conditions relating to their Prize, as determined by Apple , the provider of the Prize.

6. The Winner will be notified that they have won the Prize by Vitality via email to the current email address provided on the Form within thirty (30) working days from the Draw Date (subject to any delays that are beyond our control). The Winner will be asked to provide their home address for the Prize and the Prize will be sent to their home address within thirty (30) working days from the Draw Date (subject to any delays that are beyond our control). 

7. The Winners can use the Prize upon receipt. Vitality will not be liable if the Prize is lost, including but not limited to, in the event that the Winner has changed their contact details, and failed to notify Vitality of this change.

8. When taking part in the Prize Draw, Eligible Participants acknowledge and consent that their name and email address (in addition for the Winner, their home address) (“Personal Data”) will be made available to Vitality for administrative purposes. All Personal Data of Eligible Participants will be held and used for the purposes of this Prize Draw by Vitality in accordance with Vitality’s privacy notice (which can be found on https://www.vitality.co.uk/privacy/ or if not, requested from Vitality) and data protection legislation.

9. Eligible Participants are deemed to have accepted and agreed to be bound by these Terms and Conditions upon entry. Vitality reserves the right to refuse entry, or refuse to award the Prize to anyone in breach of these Terms and Conditions.

10. Any decisions made by Vitality over eligibility or otherwise in relation to this Prize Draw are final, will not be open to dispute and no correspondence will be entered into.

11. Vitality accepts no responsibility for entries lost, or unsuccessfully completed due to a technical fault, technical malfunction, computer hardware or software failure, satellite, network or server failure of any kind.

12. Vitality is not liable to any person in any way in relation to this Prize Draw, except for any liability that cannot be excluded by law.

13. If Vitality reasonably suspects any Eligible Participant to have committed or attempted to commit an act of fraud or dishonesty or if Vitality identifies a conflict of interest not previously disclosed, the Eligible Participant will:

a. receive no Prize; and

b. repay to Vitality upon request the monetary value of the Prize if this has already been received by the Eligible Participant.

14. Vitality reserves the right to vary, extend or withdraw this Prize Draw at any time, including in the event of fraudulent behaviour by any Eligible Participant.

15. Vitality reserves the right to substitute the Prize with another of similar value, in the event that the Prize is unavailable due to circumstances beyond Vitality’s reasonable control.

16. Same for as set out under clause 15, the Prize for the Winner is non-exchangeable, non-transferable and no cash alternative is offered.

17. Vitality reserves the right to amend these Terms and Conditions on the provision of written notice or via Vitality’s website.

18. The Prize Draw and these Terms and Conditions are governed by English law and the entrants to the Prize Draw agree to submit to the exclusive jurisdiction of English and Welsh courts and tribunals with regard to any dispute or claim arising under these Terms and Conditions.

19. The surname and county of the Winner will be made available on request by writing to the Marketing department, Vitality Corporate Services Limited, 5th Floor, Eighty Strand, London WC2R 0DT.
